These Terms of Service (“Terms”) govern access to the Ocelot-Cloud website and the subscription of premium features.

Subscriptions are purchased via Paddle, which acts as Merchant of Record and processes payments on behalf of the Maintainer.

By purchasing a subscription or using this website, you agree to these Terms.

1. Provider

Ocelot-Cloud is provided by the person or entity identified in the Imprint (“Maintainer”).

2. Description of the Product

Ocelot-Cloud is a software platform that simplifies the deployment and management of containerized applications. It may be used in self-hosted environments or, where offered, as a hosted service.

The Community Edition is available free of charge.

The Premium Edition provides additional proprietary features subject to a paid subscription.

Premium features of Ocelot-Cloud are proprietary and require a valid subscription. Use of these premium features is governed by the separate End-User License Agreement (EULA).

3. Merchant of Record and Payments

All payments are processed by Paddle.com Market Limited (“Paddle”), which acts as the Merchant of Record.

When you purchase a subscription, you enter into a transaction with Paddle. Paddle is responsible for payment processing, invoicing, VAT/sales tax calculation, and compliance with applicable payment regulations.

4. Subscriptions

Premium subscriptions:

  • Are billed on a monthly basis.
  • Renew automatically unless canceled.
  • May include applicable VAT or sales tax calculated at checkout.

You may cancel your subscription at any time through Paddle or the method provided at checkout.

After cancellation, premium features remain active until the end of the current billing period.

5. Refunds

Refunds are handled by Paddle in accordance with Paddle’s policies and applicable consumer protection laws.

If you believe you are entitled to a refund, you may contact Paddle directly or use the contact method provided in your purchase confirmation.

Statutory consumer rights remain unaffected.

6. License Activation

After purchase, you receive a license key required to activate premium features within your Ocelot-Cloud instance.

License validation may require communication with maintainer-operated infrastructure as described in the Software Privacy Notice.

7. Acceptable Use

You agree not to:

  • Use the website or software in violation of applicable laws.
  • Attempt to interfere with subscription billing or license validation systems.
  • Misrepresent your identity in connection with a purchase.

Additional restrictions regarding proprietary components are defined in the EULA.

8. Availability

The Maintainer strives to ensure website and license validation availability but does not guarantee uninterrupted access.

9. Limitation of Liability

To the fullest extent permitted by law, the Maintainer shall not be liable for indirect or consequential damages arising from use of the website or software.

This limitation does not apply where liability cannot be excluded by law, including intentional misconduct, gross negligence, or injury to life, body, or health.

10. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany.

Mandatory consumer protection laws of your country of residence remain unaffected.

11. Changes

These Terms may be updated to reflect legal or operational changes. The version published on this website applies at the time of purchase.
